HCS SB 175 -- FOOD AND BEVERAGES
SPONSOR: Loudon (Cooper, 120)
COMMITTEE ACTION: Voted "do pass by consent" by the Committee on
Tax Policy by a vote of 16 to 0.
This substitute creates a food recovery program for restaurants
and charitable or nonprofit organizations to provide food to
needy persons.
Definitions for "donor," "food," "perishable food," and "prepared
food" are created. Any donor and charitable or nonprofit
organization acting in good faith will not be subject to criminal
penalty or civil damages arising from the condition of the food.
The substitute also repeals various outdated statutes related to
inspection of non-intoxicating beverages by the Department of
Health and Senior Services.
FISCAL NOTE: No impact on state funds.
PROPONENTS: Supporters say that the bill will allow donations of
food to the needy by restaurants and nonprofit organizations who
in the past were unable to do so because of tight restrictions
and potential liability.
Testifying for the bill was Representative Cunningham (86) for
Senator Loudon.
OPPONENTS: There was no opposition voiced to the committee.
